摘　　要：针对我国海商法中实际承运人制度在理论研究和实际运用中的分歧,从多个角度来探究实际承运人法律制度,清晰地界定了“实际承运人”这一概念,划分了实际承运人和承运人的责任范围,分析了实际承运人责任性质及责任追究的程序,以期对完善实际承运人法律制度有所裨益。By virtue of the fairly new system of actual carrier and some defects in legislation or judicial interpretation, there are many differences in academic study and shipping practice. The legal system of actual carrier is analyzed from various angles. The meaning of 'actual carrier' is clearly defined. The scope of liabilities between the actual carrier and the carrier is divided. The nature of the actual carrier′s responsibilities as well as the procedure in finding out his responsibilities is analyzed. It is expected to improve the legal system of actual carrier.
