摘　　要：司法独立是现代法治的基本要求,法官独立是其核心内容,独立的审判活动有利于制约立法、行政权力,防止他们对公民合法权益的侵犯。审判监督是国家对司法机关的审判活动的合法性、公正性进行的监督。法官独立与审判监督的目的,都是为了保障司法审判活动的公正性。法官独立是审判监督的前提和基础,审判监督则是法官独立的重要保障。在分析我国法官独立与审判监督的现状的基础上,笔者认为在建设我国法官独立制度的同时需要完善对法官审判工作的监督。Judicial independence is the basic demand of modern law and judge's independence is its key content.The independent trial procedure helps to restrict legislating or administrative power,and it will prevent their infringement of citizen's legitimate rights and interests.Adjudication supervision ensures the legitimacy and fairness of the trial procedure to the judicial authority.The purpose of these two things is to ensure the fairness of the trial procedure.Judge's independence is the prerequisite and foundation of the adjudication supervision,and the latter will guarantee the judge's independence.Analysing the trial procedure in our country,we think,we should perfect our adjudication supervision system while building judge's independent system.
