摘　　要：债权人可依据一定的程序或方法行使代位权以防止债务人不当地处分其财产,从而保护自己的债权。代位权既可用诉讼方式进行,也可以直接行使。债权人向次债务人提起代位权诉讼,人民法院审理后认定代位权成立的,由次债务人向债权人履行清偿义务,债权人与债务人、债务人与次债务人之间相应的债权债务关系予以消灭。On the basis of some procedure, the debtee can exercise his subrogation to prevent the debitor unproperly separated the property, and protect his own claim. The subrogation can be carried out in a procedural way or in a direct way. When subrogation is maintained by the court, the mortgagee following next should exercise the liability for satisfaction and the relationship between the debtee and debtor, the debtor and the mortgagee following next will disappear.
