日本汉方药专利保护战略对我国的启示

摘　　要：日本企业历来重视专利保护战略的运用。目前,日本在中药制药的某些领域已占据领先地位,这与日本药品专利制度的建立推动了日本药业的发展有关,更与日本医药企业建立了系统完善的专利战略有密切关系。本文通过对日本医药企业主要专利战略的分析,探讨了汉方药专利保护对我国企业的借鉴和启示,提出了我国医药企业在制定专利保护战略时应注重的问题。Enterprises in Japan have always paid great attention to the application of the strategy for the protection of patents. At present , Japan has taken leading position in some of the pharmaceutical areas of Chinese medicine . This is in connection with the fact that the establishment of the system of drug patent in Japan has pushed ahead the pharmaceutical industry, but has all the more had close relations with the establishment of a systematic and perfect patent strategy in the pharmaceutical enterprises of that country. By analyzing some principal patent strategies of Japanese pharmaceutical enterprises, this article probes the enlightenment and reference that the patent protection of Chinese priscription medicine in Japan may provide for Chinese enterprises and put forward problems which should be given much attention by enterprises in the formulation of their strategy for the protection of patents.
