摘　　要：信托作为一种特定的财产管理制度,要求受托人为受益人的最大利益处理信托事务。而信托行为失效从根本上背离了信托设立的目的,成为阻碍信托发展的罪魁祸首。研究了信托行为失效的内涵及表现、制度在规范信托行为中的作用、信托行为失效产生的制度运行机理以及从制度的角度寻求对信托行为失效的治理。The entrust , as a special property management system, demands the assignee to deal with entrust affairs from the beneficiary's biggest interest, while the invalidation of entrust goes against basically the goal of setting up of the entrusting and becomes the first obstruction to the development of entrust. This article studies the connotation of invalidation of entrust and acquits; the system's function in regulating the entrust, the factors of invalidation of entrust and the harnessing of the invalidation of entrust from the systemic angle.
