无因管理主观构成要件之批判

摘　　要：通过对无因管理的构成要件进行的初步探讨及对无因管理的概念、立法例、性质等进行的简短概述,对我国民学界中关于无因管理要件的两种观点(即三要件说和四要件说)中的主观要件进行了彻底批判,并在对传统观点进行批判的基础上,提出了作者自己的观点——二要件说。This paper makes a preliminary study of the composition of voluntary service. After briefly summing up the concept, legislative example and the nature of voluntary service, this paper passes criticism on the subjective important conditions of two kinds of views. After criticizing traditional arguments on voluntary service, the author has produced his own argument-two important conditions of voluntary service.
