摘　　要：环境刑法的根本目的是保护环境法益,而我国现行刑事立法只注重对环境犯罪侵害人身、财产法益的保护。在绿色文明时代,我国环境刑事立法应确认环境法益在环境犯罪所侵犯的刑法法益中的主导性地位,树立环境刑法法益在整个环境刑事立法上的指导形象。The basic goal of environmental criminal law is to protect the legal b enefit. However the present criminal legislation only pay attention to the prote ction of legal benefit of human and property in environmental criminals. In age of green civilization, Chinese legislation of environmental criminal should conf irm the leading status of the legal benefit of environmental criminal law and ta ke it as the guidance of the criminal legislation of environment.
