摘　　要：刑事判例拘束力的定位是困扰我国刑事判例制度建构的一个主要问题。文章拟通过对国外刑事判例拘束力现状和我国刑事判例法渊地位的分析,探讨我国刑事判例拘束力的合理定位,以期有益于我国刑事判例制度的建构。The orientation of the constraint of criminal prejudication is one of the main problems in Chinese criminal prejudication system.The paper tries to discuss the aptitude orientation of the constraint by analyzing current situation of the constraint in order to benefit the system construction.
