摘　　要：我国民事立法史上对国际惯例的规定存在诸多不足。国际惯例的特性、功能和效力影响我国民法典的制定。应对国际惯例予以深入思考和科学对待,并在民法典中确立国际惯例的应有地位。After joining WTO, it is vital for us to get further familiar with and abide by the international customs. In our present civil law, legislation of international customs is so imperfect that it is harmful for our international commercial activities. So we must scientifically establish the important status of international customs in our new Civil Code.
