摘　　要：近些年来,我国几起商标反向假冒案件的出现立即引起经济学界及法学界的广泛关注,反向假冒行为的认定及其对社会的危害该如何解决等问题引发了关于商标反向假冒行为的激烈讨论。本文着重从商标反向假冒行为的特征、表现形式、定性及假冒者所应承担的法律责任等问题展开论述,并提出自己的见解。In recent years, the economic and law circles have widely paid attfention to the reverse counterfeit cases in our country, and how to affirm the reverse counterfeit behavier and its harmfulness and to resulve the problems lead to the lively discussion. This paper descrires the characteristics, forms determination, reverse counterfeit behavier in trademark and its law responsibility, and puts forward some views.
