债权受领性质的探讨

摘　　要：正确界定债权受领的性质,对于确定受领迟延的法律后果具有重要的意义。从各国的立法和司法实践来看,债权受领迟延的法律后果主要是一种迟延责任,在法定或约定的情况下也可能是一种违约责任,但在某些场合受领迟延并不导致债权人承担责任。因此,债权受领应是权利与义务的融合。It is important to define exactly the characters of creditor’s acceptance of payment from the debtor for deciding the legal effect of deferred acceptance. Reviewing legislations and justice practices all over the world, the creditor’s acceptance of payment is a kind of combination of right and obligation. The delay of it mostly leads to the responsibility of deferred performance, or responsibility of breaking contract under the law or contract,However, the creditor will bear no responsibility under some certain circumstance.
