我国现行夫妻损害赔偿制度的局限性

摘　　要：现行的夫妻损害赔偿制度适用范围仅限于婚姻法列举的4种行为．不足以全面地保护夫妻的人身权和财产权．适用条件仅限于夫妻离婚时或离婚后1年以内．不能保护婚姻关系存续期间夫妻的人身权和财产权。因此，它不能适应现代社会保护人权的需要。The Spouses' Damage Indemnity institoution in force, with limited applications to the four cases listed in the marriage law,can not provide an all-round protection for the spouse's personal right and property right.The condition of application is only restricted to the time when a divorce occurs or within one year after the divorce.The spouse's personal right and property right are not protected during the period of continued existence of marital relationship.It can not really provide protection to human right in modern society.
