摘 要:法律统治形式与人性善恶的逻辑关系取决于社会实践中的人伦关系设定。中国古代专制的形成是以性恶论与家国一体的现实为基础的,法律成为一种压抑人的自律意志的对立物;西方由自然法推演出民主法治的关键在于承认以人的存在与需要来评价法律的合理性,法治是与人性相一致的自律性规范体现。法律与人性关系的正确理解有利于我们反思中国法律传统、西方法治精神、马克思主义法哲学观念,进而为建构中国特色的马克思主义法律理论提供科学的方法论前提。The logical relation between the form of legal governance and the good and evil attribute of human nature rest with the enactment of human in the social practice. The formation of Chinese ancient autarchy was based on the bad man theory and the actuality of family and country incorporated, than the law became a kind of opposite thing suppressing the self-discipline will of man. But the west inferred democracy and rule of law from the theory of human nature mainly because it appraised the rationality of law by use of the existence and needs of human, and then the rule of law was a embodiment of self-discipline norm in accordance with human nature. The right comprehension of the logic relation of human nature and law makes for reconsidering Chinese legal tradition, the western rule of law and Marxist philosophy of law, and provide a scientific methodology premise for pushing forward the legal modernization with Chinese special features.
