摘　　要：由于医疗行为的高度技术性,如何确定医疗过失的判定标准在司法实践中一直是一难题。综合比较了日本、美国的医疗过失判定标准,对其进行了经济学的分析,并对我国相关立法、司法提出了建议。How to set up the criteria of judging the medical faults is a long-time difficult problem due to the high technology of the medical behavior. The paper not only compares the criteria in Japan and in the USA and makes an analyses from a perspective of economics, but also presents some suggestions for relevant legistration and judicature departments.
