摘　　要：术前医疗公证具备合法性,其实质是对西方履行术前如实告知义务和患者行使知情同意权所做的证据保全,在预防医疗纠纷及纠纷处理方面具有一定积极意义,但不是避免医疗纠纷的根本途径。医疗机构对公证病例要慎重选择并做到严谨操作,才能更好地发挥其法律效力。It is legal to have medical notarization before the operation.It can keep the proof that hospital have taken responsibility for telling according to the fact before the operation and patient have fulfilled the rights of informed consent.It will have benefit preventing medical controversy and to deal with it afterwards when it dose occur, but this is not the main way of preventing medical controversy.Hospital should carefully select the patient that need to be norarized and pay great attention while operqting to ensure better legal function.
