摘　　要：本文从法哲学的角度出发,考察了意思自治原则的历史源流,分析了意思自治原则的理论基础,认为就其本质而言,意思自治原则可理解为每一社会成员在遵循强行法的前提下,依自己的理性判断,自主决定和管理自己的事务,不受他人干涉。自然法学派为其产生和发展提供了必不可少的理论支持。From the angle of legal philosophy, this paper reviewed on the origin of party autonomy principle and analyzed its rationale. It's considered that, to the essence, party autonomy principle can be apprehended as that each social member decides and manages his own business by his rational judgment on the premise of observing compulsory laws, without being interrupted by others. Natural law school provided necessarily theory supports for its generation and development.
