职业足球俱乐部纠纷解决机制探析

摘　　要：运用法学理论分析了职业足球俱乐部间"纠纷"的典型案例。指出了中国足球协会章程中关于纠纷解决规定的缺陷,如设立诉讼委员会无依据、剥夺成员的诉权、中国足球协会自己当法官等。提出应建立、健全符合公正和效益价值的程序机制,即完善中国足球协会内部纠纷解决机制、尽快建立体育仲裁机构、重视体育调解等。The law theory was used to analyze the typical cases of the disputes among professional football clubs. It pointed out the defects existing in the regulation of solving disputes in the constitution of the Chinese Football Association, such as: setting up a lawsuit committee without any basis, depriving the lawsuit right of the members, the Chinese Football Association made itself be a judge, etc., and put forward that it's necessary to establish and sound the procedure mechanism of conforming to justice and beneficial value, i.e. improving the mechanism of the solution to internal disputes of the Chinese Football Association, establishing a sports arbitration organ as soon as possible, paying high attention to sports mediation and so on.
