摘 要:从社会学视角看,高校学生状告母校有其深厚的社会背景,目前出现了不服处罚、争讨学位或毕业证、反侵权、追索责任等四种案例类型。主要特点表现在状告对象明确;欲解决独立而具体的问题;原告以不服处罚者和争讨学位或毕业证者居多;原告败诉和未被受理多于胜诉;原告中男生多于女生等五个方面。意义积极深远、影响将越来越大、扩张面将越来越广,学生状告母校的行为应当肯定是其基本结论。From the view of sociology, there is a solid background of college students' complaint against their Alma Mater. There are four typical cases: such as refusing to accept a sentence as final, striving for degree certificate or diploma, anti-infringement, claim for liability. The main characters represented by the following respects. First, the defendant is clear. Second, the problem to be solved is independent and concrete. Third, most of the plaintiffs complain for their degree certificates or diplomas and refuse to accept a sentence as final. Fourth, the lawsuits plaintiffs lost or failed to accept are more than those of win. Fifth, the number of the male students is more than that of female. This kind of litigations is deep significant, more and more affecting and extended. As result, this action at law should be given a positive reply.
