摘 要:经过长时间的酝酿和争论,2004年欧盟各成员国领导人签署了《欧盟宪法条约》。这份条约被各成员国批准后,预计将在2006年生效。这是一部欧洲的宪法,它对欧洲的一体化进程和欧盟的发展将产生历史性的影响。各成员国能否顺利批准这份宪法条约成为全世界关注的焦点。不同的国家有不同的批准方式,但无论采取什么方式表决,都是为了寻求政治合法性的最大化。欧洲国家有使用全民公决进行重大政治决策的传统,但是这种方式在政治学上并不一定是最民主的。美国的宪法非常值得欧洲去研究,尽管它没有经过全民公决,但人们从未质疑过它的合法性。欧洲的民主传统是多样性的,既要研究美国的经验,又要考虑欧洲的历史。从长远来看,不管困难有多大,欧洲终将产生一部自己的宪法。After a long period preparation and discussions, the EU Constitutional Treaty was finally signed by the EU leaders in 2004. If it is ratified by all members, it will take effect in 2006. This is a constitution for Europe, which will be of historic significance for the European integration process and its development. Thus, whether the EU members ratify the treaty has become a topic of international focus. Different countries have different ratification processes. But whatever voting methods are used, they all aim to maximize its political legitimacy. The European countries have a tradition of making important political decisions by holding a referendum, which may not be the most democratic voting process in a political sense. The U.S. Constitution is worthy of being studied by the Europeans. Although the United States never held a referendum, no one has questioned its legitimacy. The EU democratic tradition is diversified among the different members, and the EU should learn from the experiences of the United States and should also pay due attention to its own history. The author concludes that from the long-term point of view the EU will definitely have its own Constitution despite these difficulties.
