摘　　要：对自然法学和传统人权观的超越,是当代中国人权法治建设的逻辑起点;在地方性知识与全球性知识之间的对话与合作,以发展权为当代中国人权法治的本位和重心,是当代中国人权法治发展的关键。Transcending the Natural Law School and the concepts of the traditional human rights is the logic starting of Chinese human rights＇ legalization in modern times. Taking the dialogue and cooperation between local knowledge and global knowledge, and Right to development as the pivot are the keys of human rights＇ legalization in modern China.
