德国磨房主人状告皇帝案透析——兼与中国法律史相比较

摘　　要：介绍100多年前发生在德国的“磨房主人状告威廉第一”案,透析德国人私有权神圣的观念,勾勒德国保护私有权系统的大致轮廓,比较中德私有权法律观念及制度的差别。Through the introduction of a lawsuit brought more than 100 years ago by a German miller against Emperor Wilhelm I, the paper analyzes the German idea of the sacredness of private ownership, gives an overview of the German concept and system of protection of private ownership, and compares them with the relevant Chinese concepts and systems.
