产业国际竞争中的专利策略

摘　　要：随着科技的进步和经济的发展，产业竞争已形成了国际化、知识化、白热化、有序化的格局，而专利保护在产业国际竞争中起到导向、借鉴和保护作用。本文提出了产业国际竞争中的专利策略。一类为主动策略，它包括：抢先申请，占领技术阵地；主动实施专利，尽快转化为生产力；实施专利许可，实现其商品化三个方面．另一类为专利防御策略，它包括：排除障碍阻止专利授权：绕过障碍，避免专利抵触；利用专利，争取专利实施许可三个方面。上述的专利策略在产业国际竞争中可以提供有效的法律帮助。With the development of Science and economy,industrial competition has been international, intellectual, white-hot and orderly. Patent protection becomes the guide reference for the competition.This paper puts for-ward the patent strategies,on international industrial competition,which fall into the following two cate-gories:one is the patent strategy of initiative attack which includes applying initiatively ,occupying technologi-cal position;putting patent into effect,changing patent into productive force and obtaining patent permission to let it be commertialized.The other is the patent strategy of defence,ircluding getring rid of obstacle to pre-vent patent from being admitted;getting around obstacle to avoid patent conflict and making use of patent tobe implemented.The above patent strategies can be very helpful to the law implementation in international in -dustrial competition.
