摘　　要：对于非法拘禁罪之结果加重犯,"重伤"的判断原则上应以行为时为准,"死亡"的判断应以综合说为据"重伤"与"死亡"应能客观地向非法拘禁行为归责,非法拘禁行为必须制造出导致"重伤"、"死亡"的不可容许的风险并使之现实化行为人对"重伤"、"死亡"的主观罪过只能是过失。As to the aggregated consequential offense of false imprisonment,it is to lie on the behaving principle to judge gravebodilyinjury,and lie on the synthesized view to judge death.The liabilities of gravebodilyinjury and death could be ascribed to false imprisonment objectively.The criminal is negligent to gravebodilyinjury or death.
