摘　　要：古典政治经济学到自由主义法哲学的思想演进是对"资本立法"原则的辩护。从休谟、卢梭、斯密的古典政治经济学到黑格尔的法哲学,不仅奠定了现代法治的市民社会基础与经济学逻辑,而且深刻暴露了这种逻辑背后的现代性问题,马克思的政治经济学批判及其法哲学建构就是从这一问题展开的。The evolution from the ideology of classic political economics to that of liberalist philosophy of law embodies a defense for "capitalization legislation".Classic political economics of Hume,Rousseau and Smith and the philosophy of law by Hegel not only established the foundation of citizen society and the logic of economics for modern rule of law but also exposed the problem of modernity behind this logic.From this problem,Marx started his critique of political economy and the construction of philosophy of...
