摘　　要：文章从我国民间金融发展的困境出发,分析了政府的金融管制和民间金融法律制度的缺失对民间金融发展的影响。同时,针对民间金融发展的"合法化"观点和"正式制度安排"观点进行了反思,认为不宜以"合法化"为解决民间金融问题的起点,民间金融存在客观的合法性基础。最后,在民间金融法律制度的选择中要注重市场效率、社会公平;政府应对民间金融进行适度管制,建立特色鲜明的民间金融监管制度;构建民间金融制度框架应同时注重正式制度安排和非正式制度安排。The paper,from the quagmire of China's civil financial development,conducts an analysis of the influences of the government's financial controls and the lack of civil finance legal system on the civil financial development.Reflections are made on the ideas of folk finance development for the "legalization" and the "formal institutional arrangements",indicating that it is inappropriate to resolve the civil financial problems by "legalization" as the starting point,for there is an objective legitimacy in folk...
