摘　　要：实务的复杂性加之第三人资格的认定本身就具有相当的自由裁量空间使得行政许可第三人范围的确定缺乏一个明确的标准。这一问题的解决应当在保护的权利范围上面依据法律的规定进行推断给予保护,在利害关系上面,从时间和空间出发,结合技术、成本和政策的因素,对于第三人的范围进行确定,同时对于行政许可行为做出实施之后对偶然受到其不利影响的当事人的权益也应当进行保护。Because the situation is very complex and the confirmation need people's discretion,we still don't have one clear standard which can be accepted widely.To solve this problem,we should protect the rights from the law and take relative factors into consideration,such as time,space,technology,cost and policy.At the same time,the persons who are hurt by the permission when carrying out the permission by chance also should be protected.
