摘　　要：非公有制经济作为社会主义市场经济的重要组成部分和促进社会生产力发展的重要力量,现行宪法已从根本法的高度给予了充分肯定。但是,由于其他法律保障制度不健全,非公有制经济在主体地位、利益分配等方面仍不能与公有制经济享受平等的待遇,其发展面临诸多困难和问题。因此,建立完善的非公有制经济法律保障体系,不仅是贯彻落实宪法鼓励和支持非公有制经济发展的立法精神的需要,更重要的是建立社会主义和谐社会的要求。The construction of the social harmony lies in the effective mechanism that ensures a fairplay-oriented legal system for all components of the socialist China in regard to politics, economy and other fields. The non-state-ownership has been recognized in the Constitution as one of the major components important to stimulate the socialist labor forces. However, the current law fails to compose of specific decrees that ensure its equality in status, profit and other economic treatment. Therefore, the writers of this paper assume that the construction of the social harmony should comprise the legal mechanisms to ensure the equal opportunities for all.
