农地征地补偿费的确定与农民权益保护

摘　　要：征地补偿费的确定和分配一直是征地制度改革中重要的组成部分。由于集体土地所有权虚位,导致政府制度性寻租,征地补偿费分配不公,侵害了农民的合法权益。因此清楚的认识农地价值、合理确定和分配征地补偿费,协调好地方政府、村集体、农民在农地征用中的利益分配,保护农民的权益就成为迫切需要解决的问题。本文利用因果分析法和经济学分析方法,提出征地价格应是农地价值与农地发展权价值之和,即农地价格、生态价值、社会保障价值、农地发展权价值之和。The purpose of the paper is to confirm and distribute land requisition compensation cost, harmonize the benefits of government. village and present,presents, the rights and interests of the presents. The method of cause and effect analysis is applied. According to the results of the paper, because of the lack of collective land rights which leads to government bid-seeking and the inequity of the land requisition compensation cost. We can draw the conclusion that the land requisition compensation cost must include the value of land and the development right value.
