摘　　要：网络环境下,版权人为保护其版权作品而普遍采用的技术措施开始受到世界各国版权法的保护,同时基于利益平衡精神,中外版权法又都规定了规避技术措施的“例外”与“免责”。“合理使用”者如何在版权法许可范围内规避技术措施,以及如何利用技术措施保护自主版权,是两个看似相互冲突但又存在一定必然联系的问题。In the network environment, the technical measures taken by the copyright holders to protect their copyright works begin to be protected by copyright law all over the world. Meanwhile, based on the spirit of interest balance, both Chinese and foreign copyright laws specify “exceptions” and “exempt from responsibility” to evade technical measures. For “rational use” people, how to evade technical measures within the permission range of copyright law and bow to utilize technical measures to protect copyright are two seemingly conflicting but actually interrelated issues.
