摘　　要：立法助理制度是一项协助立法机关进行立法工作的一项立法制度,通过国外的立法实践看,它作为一种体现现代法治国家在民主基础之上追求公正的新立法制度,已经取得了很好的效果。在我国地方立法中,“要提高立法的质量”,就必须尽快建立此制度,使立法助理能够为人大代表和地方立法机关充分行使立法权提供服务,以保证地方立法既能克服非立法机关起草法案中的本位主义倾向,解决法案起草中的专业性、技术性问题,也能为法学家提供理论与实践相结合的舞台,使新时期立法观念在地方立法中得到体现。同时,为了保证立法助理作用的充分发挥,还应根据地方立法的实际,以立法的形式明确规定立法助理人员的职责、配备管理方式、待遇等等。The legislation assistant system has taken good effect as a new one based on modem democracy in foreign states. In order to improve the legislation quality. It must be soon established to serve for the full exertion of legislation. It will correct the tendency of selfness in the drafting and settle the specific problems, as well as offer a stage, on which theory and reality are combined to make the new concepts embodied in the local legislation. Meanwhile, to ensure its functions fully presented, such as the duty, the way of exertion, and the personnel＇ s treatment should be provided definitely in legislation according to the actuality.
