摘 要:业主委员会制度是建立业主财产权自治与物业管理公司专业管理相结合的新体制的基础。但由于我国业主委员会发展较晚,立法不完善,至今还存在着许多问题,主要表现在:业主委员会缺失应有的法律地位的规定;业主委员会成立中还存在很多不合理规定;有关物业服务合同的性质规定不明确;缺乏对业主委员会监督的细则规定等。通过对现行业主委员会制度进行探析,找出其中存在的问题,并提出相应的法律建议。The system of house - owner committee is the base for establishing a new system which combines the self - government of proprietorship and the professional management of property - management company. Because of the underdevelopment of house - owner committee system and its imperfect legislation in China, a lot of problems still existed. The main problems are : the lack of proper legal position of house - owner committee ; a lot of improper regulations existed in the foundation of house - owner committee ; inexplicit definition of the character of the contract of property service ; the lack of detailed rules of supervising house - owner committee, etc. Through probing into today's house -owner committee system, this article figures out some problems and gives some suggestion and comment based on these problems.
