摘 要:土地承包法的颁发与实施是为了赋予农户安全稳定的农地产权,以加快农地市场流转,促进农地有效、可持续利用。但由于农村土地政策在实施上长期过度依赖于农村集体,因而出现偏差。以农地承包经营权证发放为初始形式的农地登记制度的引入,提高了国家对农民合法土地权利的保护力度。农地承包经营权登记或发证在使农民获得完整的合法土地产权、增强农民对土地权益的了解与信心、对抗农村集体干预、降低土地交易成本等方面创造了有利于农地市场流转的条件。江苏南通的统计数据表明,在农地承包经营权发证率较高的地区,农地承包经营权流转市场越发达,农户对农地产权稳定性信心越高,农地交易费用越低。中国有必要按照规范土地登记制度要求,继续农地登记制度建设,以彻底实现农村土地制度改革。The Law of Rural Contracted Land is to assign safer and stable farm land property rights to rural families to encourage free transaction of farm land use rights which favors effective and sustainable land use. For the efforts of rural collectives, objectives of the state were not fulfilled ideally. Therefore contracted land registration system was introduced to complete the redistribution of rural land property rights more directly. Registration of contracted land rights would boost farm familieA~' entrance into land market theoretically through protection of families' legal farm rights, restriction of rural collectives' interference and cutting down transaction costs etc. Statistic from Nantong Municipality proves that farm land transaction is more prevalent where more rural families receive certificate of contracted land rights.
