摘　　要：尊重和保障人权是现代民主宪政的一项基本原则。2004年宪法修正案将“国家尊重和保障人权”载入宪法,是中国寻求实行宪政以来的首次,更是当代中国民主宪政和政治文明的最新突破和发展,它将为真正实现民主宪政奠定坚实的基础。It is a fundamental, principle of the modern democratic constitutional government to respect and ensure human rights. It is the first time for China to enter “the country respects and ensures human rights” into the Constitution in 2004 Constitutional Amendment since it sought to establish constitutionalism, the latest breakthrough and development in the democratic constitutionalism and political civilization in contemporary China. It will lay a solid foundation for the establishment of a real democratic constitutional government.
