摘　　要：义务冲突行为在我国刑法理论上少有涉及,但在现实社会中却客观存在。本文从义务冲突行为的一般认识入手,就义务冲突行为的性质、正当化的理论根据和成立条件加以分析和讨论。There exists an obligation conflict objectively in the realistic society, although it is rarely involved in the theory of our country＇s penal code. This thesis analyses and discusses the character, the theoretical basis, and the tenable condition of the obligation conflict, proceeding with its general understanding.
