摘　　要：外来物种入侵对我国的生物多样性和生态安全构成了巨大的威胁,为了保护生态环境和生物多样性,保障我国的生态安全,实现物种资源的可持续利用,建立完善的控制外来物种的法律体系是十分紧迫而必要的。但是我国现行防止外来物种入侵法律还存在很多问题,并没有充分包含入侵物种对生物多样性或生态环境破坏的相关内容,与从生物多样性保护角度控制外来物种的目标还相差甚远。我国应当在总结我国外来物种入侵的国情基础上,在立法原则的指导下,整合现有法律规定,建立我国的防止外来物种入侵法律体系。The invasion of alien species has constituted enormous threat to bio--diversity and ecological security of our country. For the protection of ecological environment and bio--diversity, guarantee of the ecological security of our country and realization of the sustainable utilization of species resources, it is very urgent and essential to set up the perfect legal system to control alien species. But there are lots of questions in our current laws of preventing alien species from invasion, which have not fully included the relevant contents that invading species destroy bio--diversity or ecological environment, still differing greatly with the goal of controlling alien species in terms of bio--diversity protection. On the basis of summarizing the national conditions about alien species of our country and under the guidance of legislative principle, our country should combine the existing legal provisions to setting up the legal system that prevent alien species from invading.
