摘　　要：很多法律问题和政治密切相关,有些政治问题也需要通过法律途径来解决。波斯纳认为,在美国的文化中,不必因为法律中渗透了大量的政策或政治而大惊小怪,因为法律从来都不是仅仅由法条构成的封闭的系统。法官应该有更高的政治敏感性,以应付各种突发事件。判决的公正与否很大程度上是力量对比折射到人们的政治共识或者道德共识的结果。Many legal issues concern the politics deeply, and some political issues need be resolved in legal way. Richard A. Posnet indicated that in culture of the USA, it was unnecessary to make a big fuss over the fact that the law was permeated by a mass of policy and politics because the law has never been a close system which was just made of the articles. Judges shall be more sensitive to the politics to deal with various precipitate events. To a great extent, the impartiality of a judgment is the consequence that people＇s political or moral consensus reflects the balance of the powers.
