摘　　要：我国现行婚姻法对意思表示瑕疵的婚姻形态仅规定了因胁迫而缔结的婚姻,实际上,在缔结婚姻行为中传统民法规定的各种意思表示瑕疵形态都是存在的。为此,一方面可以在现有的民法体系中通过法律解释来缓解两者之间的矛盾;另一方面应修改婚姻法,将存在意思表示瑕疵的婚姻形态确定为虚假婚、错误婚、欺骗婚、胁迫婚。There is only one expression for illegal marriage in current Law of Marriage in China, that is“Coercive Marriage”. In fact, there are still various kinds of illegal marriage according to our traditional civil law. Therefore, on one hand, we should alleviate the contradiction between these two according to current civil law system, and ratify Law of Marriage to establish the illegal marriage as “False Marriage”, “Mistaken Marriage”, “Deceiving Marriage” and “Coercive Marriage” on the other hand.
