摘　　要：正当防卫制度直接维护受害人的权益,但却忽视了加害人被不当防卫行为侵害的可能,欠缺对加害人合法权益的保护。作为公平正义的象征,法律有必要考虑实践中可能出现的各种情况并尽可能完善相关规定,以实现保护与惩罚之间最恰当的平衡。The establishment of the system of justifiable defence is related to the fights and interests of victims. However this system ignores consideration of inflicter＇s side, and neglectes legal right and interests of the inflicter. The law which stands for justice and righteousness should take this into consideration, and perfect this system so as to balance protection and punishment. This paper probes into the unique composing terms of the inverse defence, considers the standpoint of establishing this system, and Bings forward suggestion of legislation.
