摘　　要：一、我国市场流通法律体系现状、地位 改革开放以来，市场机制在我国国民经济中发挥的作用越来越大。从市场流通法制建设看，目前仅有少量的法律法规及一定数量的规章，与其他领域法制建设相比，明显滞后。随着市场经济的迅速发展和流通体制改革的不断深入，市场流通的主体、流通行为、交易方式曰趋多样化，现有市场流通立法已不能适应深化流通体制改革，发展现代流通方式，整顿和规范市场经济秩序，健全现代市场经济的社会信用体系的要求。具体看，主要存在以下问题：1. Status quo, status of the system of law on market trade in China Since China adopted the policy of reform and opening up in 1978, the market mechanism has been playing an increasingly important role in the national economy of China. As far as the establishment of the system of law on market trade in China is concerned, there has only been a small number of laws, administrative regulations and departmental rules on market trade in the country. As compared with those of other fields, the system of law on market trade in China has obviously lagged behind. Along with rapid development of a market economy in China and continuation of the reform of the trade system in an in-depth way in the country, market subjects, market trade behavior and ways of transaction have become increasingly multiple. The existing legislation on market trade in China can no longer meet the requirement for deepening the reform of the market trade system, developing modern trade methodology, rectifying and regulating the order of the market economy, and improving the system of social credibil- ity for the modem market economy in the country. Specifically speaking, China＇s existing legislation on market trade is problematic mainly in the following respects：
