摘　　要：在综观各国立法的基础上,归纳了特征性履行的3种立法疗式,分析了特征性履行与最密切联系原则的内在关系,并在理论上对确定特征性履行连结点的依据作出适当的分析与探究。The ＂Characteristic Performance＂ theory is adopted by countries of Continental Legal Family as a popular standard to determine contracts＇ applicable law, and it greatly benefits the reification of principle of the most significant relationship. Most of the domestic laws and international treaties take, as contracts＇ applicable law, the law of the residence, habitual residence, and central administration of the characteristic performer. Henceforth, it is necessary and helpful to conduct a theoretical analysis of its foundation as well as its unique advantages.
