“四荒地”使用权流转的产权制度缺陷及其弥补

摘　　要：“四荒地”使用权流转大大提升了“四荒地”资源的开发利用效率,但其制度安排也具有明显缺陷,其效率的获取是以丧失农村集体经济组织内一部分农户的“成员权”为代价的。文章认为,可以借助农村土地股份合作制来弥补“四荒地”产权制度安排的缺陷,并就科学界定农村集体土地所有权主体范围、确保农村土地股份合作制规范运作、实行土地使用年期财产权制度、延长“四荒地”使用期限等方面提出了建议。The transference of the use right of four types of wasteland largely promotes the efficiency in the development and utilization of the four types of wasteland. But there exist obvious defects in the system arrangement. The efficiency has been achieved at the cost of membership right of some farmers from collective economic organizations. The present article believes that this defect in the arrangement of the property rights system can be remedied with the help of the share cooperation for the rural land. The author also offers some suggestions as to scientifically defining the subject range of the ownership of the rural collective-owned land, implementing the property rights system in the period of using the land, extending the time of using the four types of wasteland and so on.
