论基层政府法治建设的定位及其发展方向

摘　　要：在国家行政体制中,各级政府的地位和性质不同,承担的任务不同,管理方式和方法亦有所区别。 基层政府是连接中央政府、省级政府和广大人民群众的“桥梁政府”、“前沿政府”。基层政府法治建设的推进, 不仅关系到基层政权的稳定,而且关系到整个执政党地位的稳定乃至整个国家的稳定。基层政府制定法规范 应有法依据并符合上位法,必须对各阶层的利益和各方面的呼声真正予以的“综合考虑”,实行民主立法和科 学立法。法治社会不仅需要法治政府,更需要公民、法人和其他组织依法履行自己的义务,积极配合政府行政 的推行。诚信政府和诚信社会、诚信公民都是法治社会真正实现的重要保证。而对诚信社会、诚信公民的培育, 在很大程度上依赖于参与型行政的推进和完善,在这方面,政府尤其是基层政府肩负着异常重大的责任。要建 立经常性的、规范性的制度,使基层政府的责任得以制度化、法律化,同时要对各种权利救济途径进行创建、协 调和整合,形成更为完备的权利救济体系。In the admistrative system of our country, different governments have different ideas of management. Grassroot governments is the bridge between central government, provincial government and the population. The propel of grassroot government＇s lawful consrtruction has not only something to do with the stability of the grassroot government, but also the stability of the leading party and the whole nation. Grassroot government should constitute laws and regulations according the laws beyond it. It must consider the benefits of all classes comprenhensively. Integral government, integral society and integral people are the important guarantee to realize the law society. However, the cultivation of the integral society and integral people depends on the propel and improvement of joining administration to some extent. In this aspect, Goverments play great roles as well as grassroot governments. Consistently and regularly regulations should be established so as to make the responsibility of grassroot governments regular and legislate. Apart from that, all kinds of ways of savings should be built, coordinated and integrated so as to make good rescue system.
