浅析学生伤害事故责任认定

摘　　要：处理学生伤害事故的一般原则应是过错责任原则,承担学生伤害事故责任赔偿的主体是学校而不是国家。学生伤害事故就其性质而言,主要是侵权民事责任。就学生伤害事故的责任形式而言,主要是赔偿损失。因此,在学生人身伤害事故的赔偿办法方面,应建立和完善学生伤害事故赔偿保障机制,尽快出台一部统一的全国适用的校园人身损害赔偿法律、法规。加强对学校学生责任事故的研究,为责任的划分探寻一条既尊重教育规律,又符合国情需要的责任事故处理办法,无论是对未来的立法还是对今天的司法,都具有重要的价值。This article considers that the normal rule of dealing with students＇ attacking accident is the rule of liability for mistake. The body to undertake the liability to pay for the compensation of the accident is the school but not the country. As the nature of students＇ attacking accident, it is mainly of civil liability for tort. As the form , it is mainly of compensation for a loss. So, in the field of the way of paying for the accidents, it is in great need of building and perfecting the indemnity quarantee mechanism of students＇ attacking accident , making laws that apply to all the schools in our country about compensation for personal injury happened in school , strengthening the research about students＇ liability accident in school and exploring a way of dealing with liability accident which respencts system of education as well as be in conformity with national conditions. It is of momenous significance in future＇ s legislation or in today＇ s justice.
