我国公众参与环境执法机制的缺失与完善

摘　　要：我国现行法律法规虽然对公众参与环境保护作了原则性规定,但可操作性不强,而且对“公众”的界定比较狭窄,其结果使公众参与环境执法的难以真正落到实处。因此有必要完善公众参与环境执法机制。完善公众参与机制必须革新环境执法理念,改革环境执法手段,规范环境执法程序,提高公众环境保护意识。Although our current law and regulations have prescribed in principle how the public participates in the environmental protection, the lack of its practicability and the narrow definition towards ＂the public＂ make it difficult to put public participation in the enforcement of environmental protection Law into practice. Thus, it is necessary to perfect fl^e mechanism for public participation in the enforcement of environmental protection Law. In order to perfect the participating mechanism, it has the necessity to renovate the conception in the enforcement of environmental protection law, to reform the means used in the enforcement of environmental protection law, to standardize the procedure in the enforcement of environmental protection law, and enhance the public awareness in environmental protection.
