摘　　要：法与利益作为法理学中的一个重要命题而倍受关注。当法律作为一种上层建筑作用于社会的整个结构时,最为直观的反映是对利益的平衡作用,并在此过程中对利益加以权衡。当然,社会中利益的协调仅仅借助法律的平衡是难以实现的,同时也需要法律的保障功能的发挥。The question of law and interest is a fundamental question of jurisprudence and attracts more attention. When law becomes an upper--class eonstructlon affecting the whole society, the direct inflection is the balancing function on interest, at the same time, it weights against interest during the course. As we known, it is difficult to compromise interest merely by the balance of law, it also need the function of safeguard of law.
