摘 要:施工企业在建筑市场竞争中,必须集中自身资源承建重、难、险工程和对企业开拓市场有利的工程,走总承包发展之路。同时,利用社会资源,作为企业资源的补充,即对工程进行专业分包或劳务分包。但是,工程项目分包会产生合同纠纷风险,企业如果对风险不能规避或将之降为可容许风险,必然阻碍施工企业发展。因此,针对工程项目分包合同可能出现的纠纷风险,进行了规避和对策方面的探讨。Under the environment of the present construction marketing competitions, a construction enterprise must concentrate its resources to undertake key, difficult and challenging works as well as any works that are in favor of market enlargement, and take the path of general contracting. Meanwhile, as a supplement to the enterprise's resources, i.e. subcontracting local labors.
