摘　　要：身分是人们在法律上所居的地位,该种地位决定其在特定情况下的权利和义务。它与法律义务的产生、分配与运行存在不可分割的关联。因此从身分角度去认识和理解法律义务、法律义务冲突具有重要的意义。法律义务冲突实质上是义务人具有法律意义上的身分之间存在无法取舍的困境。那么身分就可以为法律义务冲突的解决提供一定的信息。Identity is one＇ s legal status, which determines the right and duty in a certain circumstance. It indivisibly relates to the production, distribution and function of legal duty. Therefore, it is of great importance to understand legal duty and legal duty conflicts from the perspective of identity. Legal duty conflict means the dilemma that the obligator can not make choice between his/her legal identities. Correspondingly, identity can provide some information for the settling of legal duty conflicts.
