摘　　要：政府信息公开过程中的第三人是指政府机关拟公开的政府信息会损害除申请人或公开相对人以外的合法权益的人。判断“第三人”及第三人是否享有权利关键是看该信息是否同第三方有直接利害关系。对政府信息公开过程中的第三人权利保护可以根据不同的阶段设计制度措施。The third person in the process of opening Government information is the person that government structures would harm the legal right and interest but not the applicant. The key to judge the third person or it＇ s right is to see whether this information has direct stakes with the third party to enjoy this right. We should design the institution measures by the different stages to protect the third person in the process of opening Government infor- mation.
