摘　　要：本文试从我国涉外合同法律适用的立法史出发,结合国际条约和其他国家的立法及学说,对民法典草案涉外篇第50条所涉及的两个基本原则及其缺陷进行评析,并相应地提出了几条立法建议。The purpose of this article is trying to analyze the history of international contract legislation. Reference in this article also including the international agreement, the relative academic theories and legislations. So as to analyzing the fiftieth article of conflict rules in the Chinese Civil Code. The author gives some advice to these problems.
