对逆防卫制度的质疑

摘　　要：一些学者提出逆防卫的存在有其合理依据,认为鉴于保护不法加害人的人权以及犯罪现场复杂身份转化的要求等,应该立法确认不法加害人的逆防卫权利。但是笔者对此持否定态度,认为逆防卫制度缺乏存在的理论基础,在司法实践中也不具有可操作性,因而不应立法使其合法化。Some scholars propose the existence of the counter defense and its reasonal base. They think that the right of counter defence of the illegal party should be protected in view of the complex crime scene and the status transform. The author holds the denial manner, we think the system lacks theory base and it does not have the nature of operation in practice , so the system should not be turned legal by legislation.
